Article R6146-9-2-1 of the French Public Health Code

I. – For the application of the second paragraph of article L. 6146-1-2, the director and the chairman of the establishment’s medical commission inform the establishment’s medical commission and the nursing, rehabilitation and medical-technical care commission, which are consulted for their assent, of the result of the consultation of the establishment’s technical committee.

For the application of the third paragraph of article L. 6146-1-2, the procedures for the participation and expression of personnel in the operation of the structures created must be determined before the appointment of the heads of these structures.

II. – When the hospital is a party to a regional hospital grouping agreement as provided for in article L. 6132-1, a university hospital agreement as provided for in article L. 6143-3 or any other cooperation agreement relating to the organisation of medical operations and the provision of care, the decision to freely organise the hospital as referred to in article L. 6146-1-2 may not be taken without making the necessary changes to the agreement to bring it into line with the planned organisation.

Article R6146-9-2-1

I. – Pour l’application du deuxième alinéa de l’article L. 6146-1-2, le directeur et le président de la commission médicale d’établissement portent à la connaissance de la commission médicale d’établissement et de la commission des soins infirmiers, de rééducation et médico-techniques, saisies pour avis conforme, le résultat de la consultation du comité technique d’établissement.

Pour l’application du troisième alinéa de l’article L. 6146-1-2, les modalités de participation et d’expression des personnels au fonctionnement des structures créées doivent être déterminées avant la nomination des responsables de ces structures.

II. – Lorsque l’établissement est partie à une convention de groupement hospitalier de territoire prévue par l’article L. 6132-1, une convention hospitalo-universitaire prévue par l’article L. 6143-3 ou toute autre convention de coopération relative à l’organisation du fonctionnement médical et de la dispensation des soins, la décision de libre organisation mentionnée à l’article L. 6146-1-2 ne peut être prise sans qu’aient été apportées à la convention les modifications nécessaires pour la mettre en conformité avec l’organisation projetée.
