The Armed Forces Hospital shall respond as soon as possible to complaints and claims addressed to it, informing the complainant of the possibility of referring the matter to a mediator, except where such complaints and claims concern the Armed Forces Medical Support Mission, or informing the person concerned that he/she may do so.
It shall inform the author of the complaint or claim that he/she may be accompanied, for the meeting with the mediator provided for in Article R. 6147-130:
1° If he/she comes under the provisions of article L. 4138-2 of the Defence Code, the representative mentioned in a or c of 3° of article R. 6147-117 of this Code or their alternates,
2° If he/she comes under one of the categories mentioned in the fifth paragraph of article L. 4123-2 of the Defence Code, the representative mentioned in b or c of 3° of Article R. 6147-117 of this Code or their alternates,
3° In other cases, the representative mentioned in c of 3° of Article R. 6147-117 or his alternate.
The doctor mediator is competent to deal with complaints or claims that exclusively concern the organisation of care and the medical operation of the department, while the non-physician mediator is competent to deal with complaints or claims that do not concern these issues. If a complaint or claim concerns both mediators, it is referred to them simultaneously.
