Article R6149-1 of the French Public Health Code

I.-For the application of the second paragraph of article L. 6149-1, the director and the chairman of the establishment’s medical committee inform the establishment’s medical committee and the nursing, rehabilitation and medico-technical committee, which are asked to give a favourable opinion, of the opinion of the establishment’s technical committee.

For the application of the third paragraph of article L. 6149-1, the procedures for the participation and expression of personnel in the operation of the structures created must be determined before the appointment of the heads of these structures.

II -Where the hospital is party to a regional hospital grouping agreement provided for in article L. 6132-1, a hospital-university agreement provided for in article L. 6143-3 or any other cooperation agreement relating to the organisation of medical operations, the provision of care or governance, the decision relating to the free organisation mentioned in article L. 6149-1 may not be taken without the necessary amendments having been made to the agreement to bring it into line with the planned organisation.

Article R6149-1

I.-Pour l’application du deuxième alinéa de l’article L. 6149-1, le directeur et le président de la commission médicale d’établissement portent à la connaissance de la commission médicale d’établissement et de la commission des soins infirmiers, de rééducation et médico-techniques, saisies pour avis favorable, l’avis du comité technique d’établissement.

Pour l’application du troisième alinéa de l’article L. 6149-1, les modalités de participation et d’expression des personnels au fonctionnement des structures créées doivent être déterminées avant la nomination des responsables de ces structures.

II.-Lorsque l’établissement est partie à une convention de groupement hospitalier de territoire prévue par l’article L. 6132-1, une convention hospitalo-universitaire prévue par l’article L. 6143-3 ou toute autre convention de coopération relative à l’organisation du fonctionnement médical, de la dispensation des soins ou de la gouvernance, la décision relative à la libre organisation mentionnée à l’article L. 6149-1 ne peut être prise sans qu’aient été apportées à la convention les modifications nécessaires pour la mettre en conformité avec l’organisation projetée.
