Article R615-1 of the French Intellectual Property Code

Where the court considers, including during the course of proceedings, that the claim falls within the exclusive jurisdiction of the unified patent court pursuant to Articles L. 615-17 and L. 615-18, it shall declare of its own motion that it does not have jurisdiction and shall refer the parties back to the court for further proceedings.

When, in the course of proceedings, unitary effect is conferred on the European patent in dispute, the earliest party shall inform the court. Where unitary effect is granted in the course of deliberation, the court shall order the reopening of the proceedings.

Lorsque le juge estime, y compris en cours d’instance, que la demande relève de la compétence exclusive de la juridiction unifiée du brevet en application des articles L. 615-17 et L. 615-18, il relève d’office son incompétence et renvoie les parties à mieux se pourvoir.

Lorsqu’ en cours d’instance un effet unitaire est conféré au brevet européen objet du litige, la partie la plus diligente en informe le tribunal. Lorsque l’effet unitaire est octroyé en cours de délibéré, le tribunal ordonne la réouverture des débats.
