Article R615-5 of the French Intellectual Property Code

Where the judge has made the seizure subject to the provision of guarantees by the claimant, these must be provided before the seizure is carried out.

On pain of nullity and damages against the bailiff, the latter must, before proceeding with the seizure, give copies to the holders of the objects seized or described of the order and, where applicable, of the deed recording the provision of guarantees. A copy of the seizure report must be left with the same holders.

Lorsque le juge a subordonné la saisie à la constitution de garanties par le demandeur, celles-ci doivent être constituées avant qu’il soit procédé à la saisie.


A peine de nullité et de dommages-intérêts contre l’huissier, celui-ci doit, avant de procéder à la saisie, donner copie aux détenteurs des objets saisis ou décrits de l’ordonnance et, le cas échéant, de l’acte constatant la constitution de garanties. Copie doit être laissée aux mêmes détenteurs du procès-verbal de saisie.
