Article R6152-15 of the French Public Health Code

Practitioners appointed under 4° or 5° of article R. 6152-7 are classified in the post of hospital practitioner, taking into account :

1° The legal length of national service and compulsory military service, in accordance with the rules applicable to civil servants;

2° Hospital services completed abroad under a cooperation contract;

3° The duration of the same type of duties carried out prior to their appointment and of interest to the public hospital service, in France or in a Member State of the European Union or another State party to the Agreement on the European Economic Area, provided that they can prove that they carried out these duties while holding the qualifications, diplomas or authorisations required in France to practise their profession;

4° The length of service completed by the practitioners mentioned in 4° of article L. 6152-1.

For the application of these provisions, the duration of the training required to obtain the diploma of doctor, pharmacist or odontologist, or the specialist diploma, whatever the status of the practitioner during the training and the duration of this training in the country in which the specialist diploma was obtained, is not taken into account.

Practitioners appointed under 5° of article R. 6152-7 who, before the entry into force of decree no. 2020-1182 of 28 September 2020 relating to the modification of the salary scale for full-time hospital practitioners and part-time hospital practitioners, had the status of hospital practitioner or part-time hospital practitioner and who resigned in application of the provisions of articles R. 6152-97 or R. 6152-270 are classified in the post of hospital practitioner in accordance with the following table:

Les praticiens nommés au titre des 4° ou 5° de l’article R. 6152-7 sont classés dans l’emploi de praticien hospitalier, compte tenu :

1° De la durée légale du service national et des services militaires obligatoires, selon les règles applicables aux fonctionnaires de l’Etat ;

2° Des services hospitaliers accomplis à l’étranger en application d’un contrat de coopération ;

3° De la durée des fonctions de même nature effectuées antérieurement à leur nomination et présentant un intérêt pour le service public hospitalier, en France ou dans un Etat membre de l’Union européenne ou d’un autre Etat partie à l’accord sur l’Espace économique européen, sous réserve de justifier avoir accompli celles-ci en détenant les titres, diplômes ou autorisations exigés en France pour l’exercice de leur profession ;

4° De la durée des services accomplis par les praticiens mentionnés au 4° de l’article L. 6152-1.

Pour l’application de ces dispositions, la durée de la formation requise pour l’obtention du diplôme de médecin, pharmacien ou odontologiste, ou du diplôme de spécialité, quels que soient le statut du praticien durant la formation et la durée de cette dernière dans le pays d’obtention du diplôme de spécialité, n’est pas prise en compte.

Les praticiens nommés au titre du 5° de l’article R. 6152-7 qui, avant l’entrée en vigueur du décret n° 2020-1182 du 28 septembre 2020 relatif à la modification de la grille des émoluments des praticiens hospitaliers à temps plein et des praticiens des hôpitaux à temps partiel, avaient la qualité de praticien hospitalier ou de praticien des hôpitaux à temps partiel et qui ont démissionné en application des dispositions des articles R. 6152-97 ou R. 6152-270 sont classés dans l’emploi de praticien hospitalier conformément au tableau suivant :
