Article R6152-318 of the French Public Health Code

The Disciplinary Board comprises:

1° A chairman and an alternate chairman, members of the Conseil d’Etat, appointed on a proposal from the vice-chairman of the Conseil d’Etat;

2° Six full members and six alternate members representing the administration, including :

a) One full member and one alternate member, appointed on the recommendation of the Director General of Health;

b) One full member and one alternate member, appointed on the recommendation of the Director General of Healthcare;

c) One full member and one alternate member, who are members of the Inspectorate General of Social Affairs, appointed on the recommendation of the Head of the Inspectorate General of Social Affairs;

d) One full member and one alternate member, who are members of the body of medical public health inspectors or the body of pharmacist public health inspectors, appointed by the Minister for Health;

e) One full member and one alternate member, members of the management staff of the establishments mentioned in 1° and 2° of article 2 of law no. 86-33 of 9 January 1986 on statutory provisions relating to the hospital civil service, appointed on the proposal of the most representative organisation of the establishments mentioned in the same article 2;

f) One full member and one alternate member, appointed on the proposal of the Director General of the Centre National de Gestion;

For the appointment of the representatives of the administration, the Disciplinary Board shall ensure balanced representation of the distribution between women and men.

3° Six full and alternate representatives, elected by the college of hospital practitioners for each of the following seven sections:

a) Medicine and medical specialities;

b) Psychiatry;

c) Surgery, surgical specialities and odontology;

d) Radiology;

e) Biology;

f) Anaesthesia and intensive care;

g) Pharmacy.

A single college of hospital practitioners is set up for each of these sections.

The members of the Disciplinary Board are appointed by order of the Director General of the Centre National de Gestion, published on the Centre’s website. The order sets the effective date of the term of office of the elected members of the committee.

Le conseil de discipline comprend :

1° Un président et un président suppléant, membres du Conseil d’Etat, nommés sur proposition du vice-président du Conseil d’Etat ;

2° Six membres titulaires et six membres suppléants représentant l’administration dont :

a) Un membre titulaire et un membre suppléant, nommés sur proposition du directeur général de la santé ;

b) Un membre titulaire et un membre suppléant, nommés sur proposition du directeur général de l’offre de soins ;

c) Un membre titulaire et un membre suppléant, membres de l’inspection générale des affaires sociales, nommés sur proposition du chef de l’inspection générale des affaires sociales ;

d) Un membre titulaire et un membre suppléant, membres du corps des médecins inspecteurs de santé publique ou du corps des pharmaciens inspecteurs de santé publique, désignés par le ministre chargé de la santé ;

e) Un membre titulaire et un membre suppléant, membres du corps des personnels de direction des établissements mentionnés aux 1° et 2° de l’article 2 de la loi n° 86-33 du 9 janvier 1986 portant dispositions statutaires relatives à la fonction publique hospitalière, nommés sur proposition de l’organisation la plus représentative des établissements mentionnés à ce même article 2 ;

f) Un membre titulaire et un membre suppléant, nommés sur proposition du directeur général du Centre national de gestion ;

Pour la désignation des représentants de l’administration, le conseil de discipline a vocation à assurer la représentation équilibrée de la répartition entre les femmes et les hommes.

3° Six représentants titulaires et suppléants, élus par le collège des praticiens hospitaliers pour chacune des sept sections suivantes :

a) Médecine et spécialités médicales ;

b) Psychiatrie ;

c) Chirurgie, spécialités chirurgicales et odontologie ;

d) Radiologie ;

e) Biologie ;

f) Anesthésie-réanimation ;

g) Pharmacie.

Pour chacune de ces sections, il est constitué un collège unique des praticiens hospitaliers.

Les membres du conseil de discipline sont nommés par arrêté du directeur général du Centre national de gestion publié sur le site internet de ce centre. L’arrêté fixe la date d’effet du mandat des membres élus de la commission.
