Article R6152-375 of the French Public Health Code

If, at the end of the contract, the employment relationship is not continued, the contractual practitioner is entitled to an indemnity intended to compensate for the precariousness of his situation.

This allowance is not payable in the cases mentioned in 3° and 4° of article L. 1243-10 of the Labour Code, nor in the event that the practitioner, who is on the list of suitable candidates mentioned in article R. 6152-308, does not apply for a position in his establishment and in his speciality.

The amount and terms of payment of the allowance are set by order of the ministers responsible for the budget and health.

Lorsqu’au terme du contrat, la relation de travail n’est pas poursuivie, le praticien contractuel a droit à une indemnité destinée à compenser la précarité de sa situation.


Elle n’est pas due dans les cas mentionnés aux 3° et 4° de l’article L. 1243-10 du code du travail ni dans le cas où le praticien, inscrit sur la liste d’aptitude mentionnée à l’article R. 6152-308, ne postule pas sur un poste ouvert dans son établissement et dans sa spécialité.


Le montant et les modalités de versement de l’indemnité sont fixés par arrêté des ministres chargés du budget et de la santé.
