Article R6152-385 of the French Public Health Code

The interview(s) provided for in article R. 6152-383 mainly concern :

1° The reasons for the request and the principle of the contractual termination;

2° Setting the date on which the contract will end;

3° The proposed amount of the contractual termination indemnity provided for in article R. 6152-381 ;

4° The consequences of the contractual termination, in particular the entitlement to unemployment insurance, the obligation to reimburse provided for in article R. 6152-389 and compliance with the ethical obligations provided for inarticle 25 octies of law no. 83-634 of 13 July 1983 on the rights and obligations of civil servants, article R. 4127-95 of the Public Health Code andarticle 432-13 of the Criminal Code.

Le ou les entretiens prévus à l’article R. 6152-383 portent principalement sur :


1° Les motifs de la demande et le principe de la rupture conventionnelle ;


2° La fixation de la date de la fin du contrat ;


3° Le montant envisagé de l’indemnité de rupture conventionnelle prévue à l’article R. 6152-381 ;


4° Les conséquences de la rupture conventionnelle, notamment le bénéfice de l’assurance chômage, l’obligation de remboursement prévue à l’article R. 6152-389 et le respect des obligations déontologiques prévues à l’article 25 octies de la loi n° 83-634 du 13 juillet 1983 portant droits et obligations des fonctionnaires, à l’article R. 4127-95 du code de santé publique et à l’article 432-13 du code pénal.
