Practitioners governed by this section participate in continuity of care or pharmaceutical duty with other practitioners in the establishment, subject to the provisions of article R. 6152-632.
In this respect, practitioners attached, in particular :
1° In facilities organised on a continuous basis, work day and night shifts under the conditions defined by the internal regulations and the duty roster;
2° In other structures, they are responsible for daily morning and afternoon work and, in addition, participate in the continuity of care, or in pharmaceutical duty organised either on site or on call at home;
3° Whatever the structure, participate in the replacements required by the various leaves or occasional absences of the establishment’s practitioners;
4° Whatever the structure, respond to exceptional and urgent hospital needs that arise outside their service obligations.
However, if the interests of the service so require, the director of the establishment, after obtaining the opinion of the chairman of the establishment medical committee or, where applicable, the local establishment medical committee, may decide to suspend the participation of a practitioner attached to the continuity of care or pharmaceutical duty at night, on Saturday afternoons, Sundays and public holidays for a maximum period of three months. He shall immediately inform the Director General of the Regional Health Agency. At the end of this period, if the practitioner is not authorised again to participate in continuity of care or pharmaceutical duty, his case is submitted to the medical committee referred to in article R. 6152-36 or is subject to the procedure relating to professional incompetence or the disciplinary procedure provided for in this section.
