Article R6152-715 of the French Public Health Code

In the event of serious misconduct, the Director may, after having communicated the grievances to the person concerned and having invited him to present his observations within a period of eight days, terminate the contract, without compensation, by a reasoned decision taken after obtaining the opinion of the establishment’s medical committee. This decision is notified to the practitioner concerned.

Hospital practitioners seconded on contract in application of 3° of article L. 6152-1 remain subject to the provisions of sub-section 8 of section 1 for full-time hospital practitioners and sub-section 9 of section 2 of this chapter for part-time hospital practitioners.

En cas de faute grave, le directeur peut, après avoir communiqué les griefs à l’intéressé et l’avoir invité à présenter ses observations dans un délai de huit jours, mettre fin au contrat, sans indemnité, par décision motivée prise après avis de la commission médicale d’établissement. Cette décision est notifiée au praticien intéressé.



Les praticiens hospitaliers détachés sur contrat en application du 3° de l’article L. 6152-1 restent soumis aux dispositions de la sous-section 8 de la section 1 s’agissant des praticiens hospitaliers à temps plein et de la sous-section 9 de la section 2 du présent chapitre s’agissant des praticiens des hôpitaux à temps partiel.
