Article R6152-75 of the French Public Health Code

The case is referred to the Disciplinary Board by the Director General of the Centre National de Gestion.

The practitioner concerned must be notified at least two months in advance, by registered letter with acknowledgement of receipt, of the date of his appearance before the Disciplinary Board and be given full access to his file. He may submit written or oral observations to the Disciplinary Board, call witnesses and be assisted by a defender of his choice.

The administration also has the right to call witnesses.

The Disciplinary Board shall hear all persons it deems necessary to summon. It shall take note of the observations of the Director General of the Regional Health Agency, the Director of the establishment and the Medical Committee of the establishment where the practitioner works, sitting in a formation restricted to permanent practitioners and without the presence of the practitioner.

The Disciplinary Board may order any additional investigation likely to enlighten it.

Le conseil de discipline est saisi par le directeur général du Centre national de gestion.

Le praticien intéressé doit être avisé au moins deux mois à l’avance, par lettre recommandée avec demande d’avis de réception, de la date de sa comparution devant le conseil de discipline et avoir communication intégrale de son dossier. Il peut présenter devant le conseil de discipline des observations écrites ou orales, faire entendre des témoins et se faire assister d’un défenseur de son choix.

Le droit de citer des témoins appartient également à l’administration.

Le conseil entend toutes les personnes qu’il estime devoir convoquer. Il prend connaissance des observations du directeur général de l’agence régionale de santé, du directeur de l’établissement et de la commission médicale de l’établissement où exerce le praticien siégeant en formation restreinte aux praticiens titulaires et hors la présence du praticien.

Le conseil de discipline peut ordonner toute enquête complémentaire susceptible de l’éclairer.
