Article R6152-80 of the French Public Health Code

When the national status committee is called upon to give an opinion on the professional inadequacy of a hospital practitioner, it sits with a composition and according to the procedures determined in articles R. 6156-69 to R. 6156-78.

The matter is referred to the national statutory commission by the Director General of the Centre National de Gestion after obtaining the opinion of the medical commission of the establishment to which the practitioner is assigned, sitting in a formation restricted to permanent practitioners, and of the Director General of the Regional Health Agency.

The establishment’s medical committee delivers its opinion within two months of the date on which it is convened. Failing this, only the opinion of the chairman of the hospital medical board is required.

The person concerned will be given access to his file two months before his appearance before the committee. He may be assisted by one or more experts of his choice and may call witnesses.

The administration may also appoint experts and call witnesses.

Lorsque la commission statutaire nationale est appelée à donner un avis sur l’insuffisance professionnelle d’un praticien hospitalier, elle siège dans une composition et selon des modalités déterminées aux articles R. 6156-69 à R. 6156-78.

La commission statutaire nationale est saisie par le directeur général du Centre national de gestion après avis de la commission médicale de l’établissement où est affecté le praticien, siégeant en formation restreinte aux praticiens titulaires, et du directeur général de l’agence régionale de santé.

La commission médicale d’établissement rend son avis dans un délai de deux mois à compter de la date de sa convocation. A défaut, seul est requis l’avis du président de la commission médicale d’établissement.

L’intéressé a communication de son dossier deux mois avant sa comparution devant la commission. Il peut se faire assister par un ou plusieurs experts de son choix et citer des témoins.

L’administration peut également désigner des experts et citer des témoins.
