When the national status committee is called upon to give an opinion on the professional inadequacy of a hospital practitioner, it sits with a composition and according to the procedures determined in articles R. 6156-69 to R. 6156-78.
The matter is referred to the national statutory commission by the Director General of the Centre National de Gestion after obtaining the opinion of the medical commission of the establishment to which the practitioner is assigned, sitting in a formation restricted to permanent practitioners, and of the Director General of the Regional Health Agency.
The establishment’s medical committee delivers its opinion within two months of the date on which it is convened. Failing this, only the opinion of the chairman of the hospital medical board is required.
The person concerned will be given access to his file two months before his appearance before the committee. He may be assisted by one or more experts of his choice and may call witnesses.
The administration may also appoint experts and call witnesses.
