Article R6152-907 of the French Public Health Code

When an associate practitioner is assigned to a private health establishment or a private health establishment of collective interest to carry out his skills consolidation programme, he is made available to this establishment.

This secondment is decided by the director of the university hospital centre to which the associate practitioner is attached, after signature of an agreement between the university hospital centre and the host establishment. A copy of the decision is sent to the Director General of the Regional Health Agency.

This agreement specifies in particular the duration of the secondment as well as the conditions of practice, the department to which the patient is assigned and the referring practitioner for the duration of the secondment.

It provides for the reimbursement of the remuneration and corresponding charges by the host establishment.

It may, however, provide for total or partial, temporary or permanent exemption from this reimbursement.

Lorsqu’il est affecté dans un établissement de santé privé ou un établissement de santé privé d’intérêt collectif pour la réalisation de son parcours de consolidation de compétences, le praticien associé est mis à disposition de cet établissement.

La mise à disposition est prononcée par le directeur du centre hospitalier universitaire de rattachement, après signature d’une convention passée entre le centre hospitalier universitaire et l’établissement d’accueil. Une copie de la décision est adressée au directeur général de l’agence régionale de santé.

Cette convention précise notamment la durée de la mise à disposition ainsi que les conditions d’exercice, le service d’affectation et le praticien référent pendant la durée de la mise à disposition.

Elle prévoit le remboursement de la rémunération et des charges correspondantes par l’établissement d’accueil.

Elle peut toutefois prévoir l’exonération totale ou partielle, temporaire ou permanente, de ce remboursement.
