Article R6156-47 of the French Public Health Code

Practitioners who meet the conditions for inclusion on the electoral list for a section of the national statutory commission may be elected to that section.

However, the following may not be elected:

1° Practitioners on long-term leave;

2° Practitioners who have been subject to a reduction in seniority leading to a reduction in emoluments, suspension with total or partial withdrawal of emoluments or compulsory transfer, unless they have been granted amnesty or have benefited from a decision accepting their request that no trace of the sanction imposed should remain in their file;

3° Practitioners disqualified under articles L. 5 and L. 6 of the Electoral Code.

Article R6156-47

Sont éligibles au titre d’une section de la commission statutaire nationale, les praticiens remplissant les conditions pour être inscrits sur la liste électorale de cette section.

Toutefois, ne peuvent être élus :

1° Les praticiens en congé de longue durée ;

2° Les praticiens qui ont été frappés d’une réduction d’ancienneté de services entraînant une réduction des émoluments, d’une suspension avec suppression totale ou partielle des émoluments ou d’une mutation d’office, à moins qu’ils n’aient été amnistiés ou qu’ils n’aient bénéficié d’une décision acceptant leur demande tendant à ce qu’aucune trace de la sanction prononcée ne subsiste à leur dossier ;

3° Les praticiens frappés d’une des incapacités énoncées aux articles L. 5 et L. 6 du code électoral.
