Article R6156-70 of the French Public Health Code

The following persons may not sit on the committee

1° The spouse of the practitioner concerned or any person related to the latter by blood or marriage up to and including the fourth degree;

2° Any person who initiated the procedure;

3° The author of the investigation whose conclusions prompted the referral of the matter to the Commission;

4° The practitioner who is the subject of the procedure;

5° The doctors and pharmacists practising in the regional health agency in the region where the practitioner concerned is practising;

6° Any person performing their duties or holding an office in the establishment where the practitioner who is the subject of the procedure works.

Ne peuvent siéger à la commission :


1° Le conjoint du praticien intéressé ou la personne ayant avec ce dernier un lien de parenté ou d’alliance jusqu’au quatrième degré inclus ;


2° Toute personne qui est à l’origine de la procédure ;


3° L’auteur de l’enquête dont les conclusions ont motivé la saisine de la commission ;


4° Le praticien qui fait l’objet de la procédure ;


5° Les médecins et les pharmaciens exerçant dans l’agence régionale de santé de la région où exerce le praticien concerné ;


6° Toute personne exerçant ses fonctions ou investie d’un mandat dans l’établissement où exerce le praticien qui fait l’objet de la procédure.
