Article R621-1 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The administrative authority competent to take the surrender decision pursuant to articles L. 621-1 to L. 621-7 is the departmental prefect and, in Paris, the police prefect.
However, in the cases provided for in articles L. 621-2 and L. 621-3, the prefect may delegate his signature to a police officer in departments sharing a border with one or more Member States of the European Union or the Swiss Confederation for surrender decisions to the authorities of one of these States. The official must have at least the rank of police lieutenant.

Article R621-1

L’autorité administrative compétente pour prendre la décision de remise en application des articles L. 621-1 à L. 621-7 est le préfet de département et, à Paris, le préfet de police.
Toutefois, dans les cas prévus aux articles L. 621-2 et L. 621-3, le préfet peut déléguer sa signature à un fonctionnaire de police dans les départements ayant une frontière commune avec un ou plusieurs Etats membres de l’Union européenne ou la Confédération suisse pour les décisions de remise aux autorités d’un de ces Etats. Le fonctionnaire a au moins le grade de lieutenant de police.
