Article R621-37-2 of the French Monetary and Financial Code

The statement of objections, which includes a proposal to initiate the administrative composition procedure, is sent to the accused party in accordance with the conditions set out in the first paragraph of Article R. 621-38. It specifies that the addressee may obtain a copy of the documents in the case file from the Board’s secretariat and be assisted or represented by any counsel of his or her choice.

The addressee has a period of one month from receipt of this notification in which to comment on the proposal, by registered letter with acknowledgement of receipt.

La notification des griefs qui comporte la proposition d’entrée en voie de composition administrative est adressée à la personne mise en cause dans les conditions prévues au premier alinéa de l’article R. 621-38. Elle précise que son destinataire peut prendre connaissance et copie des pièces du dossier auprès du secrétariat du collège et se faire assister ou représenter par tout conseil de son choix.

Le destinataire dispose d’un délai d’un mois à compter de la réception de cette notification pour se prononcer sur la proposition, par lettre recommandée avec demande d’avis de réception.
