Article R621-5 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The administrative authority designated in article R. 621-1 may, in application of the provisions of article L. 621-4, take a surrender decision against a foreign national holding long-term resident status – EU granted by another State, in the following cases:
1° The foreign national has resided on French territory for more than three consecutive months without complying with the provisions of article L. 426-11;
2° The foreign national has been refused the issue or renewal of a temporary or multi-annual residence permit in application of article L. 426-11 or the withdrawal of a temporary or multi-annual residence permit issued in application of the same article.

L’autorité administrative désignée à l’article R. 621-1 peut, en application des dispositions de l’article L. 621-4, prendre une décision de remise à l’encontre de l’étranger titulaire du statut de résident de longue durée – UE accordé par un autre Etat, dans les cas suivants :
1° L’étranger a séjourné sur le territoire français plus de trois mois consécutifs sans se conformer aux dispositions de l’article L. 426-11 ;
2° L’étranger fait l’objet d’un refus de délivrance ou de renouvellement d’une carte de séjour temporaire ou pluriannuelle en application de l’article L. 426-11 ou du retrait d’une carte de séjour temporaire ou pluriannuelle délivrée en application du même article.
