Article R621-6 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The administrative authority may, in application of the provisions of article L. 621-4, take a surrender decision against a family member of a foreign national holding long-term resident-EU status granted by another State, mentioned in articles L. 426-12 and L. 426-13, when this family member:
1° Has stayed for more than three consecutive months on French territory without complying with the provisions of articles L. 426-12 or L. 426-13;
2° Has been refused the issue or renewal of the temporary residence permit bearing the words “private and family life” mentioned in articles L. 426-12 and L. 426-13 or the multi-annual residence permit mentioned in article L. 433-4 or the withdrawal of one of these residence permits.

L’autorité administrative peut, en application des dispositions de l’article L. 621-4, prendre une décision de remise à l’encontre d’un membre de la famille d’un étranger titulaire du statut de résident de longue durée-UE accordé par un autre Etat, mentionné aux articles L. 426-12 et L. 426-13, lorsque ce membre de famille :
1° A séjourné plus de trois mois consécutifs sur le territoire français sans se conformer aux dispositions des articles L. 426-12 ou L. 426-13 ;
2° A fait l’objet d’un refus de délivrance ou de renouvellement de la carte de séjour temporaire portant la mention ” vie privée et familiale ” mentionnée aux articles L. 426-12 et L. 426-13 ou de la carte de séjour pluriannuelle mentionnée à l’article L. 433-4 ou du retrait de l’une de ces cartes de séjour.
