Article R622-3 of the French Intellectual Property Code

The benefit of the filing date is acquired by the applicant on the date of submission of the documents provided for in the preceding article. This benefit shall accrue to him even if the documents are irregular in form, provided that their regularisation does not result in any change in the representation of the topography filed.

In the event of non-conformity of the filing or material irregularity, the applicant shall be notified to regularise the filing within a period which shall be set by the Director General of the National Institute of Industrial Property and which may not be less than two months or more than four months. If the filing is not put in order, it is rejected.

The filing is registered as soon as it is recognised as being in order. The registration is notified to the applicant and mentioned in the Official Industrial Property Bulletin.

Le bénéfice de la date de dépôt est acquis au déposant à la date de remise des pièces prévues à l’article précédent. Ce bénéfice lui est acquis même si les pièces sont irrégulières en la forme, sous réserve que leur régularisation n’entraîne aucun changement dans la représentation de la topographie déposée.

En cas de non-conformité du dépôt ou d’irrégularité matérielle, notification est faite au déposant d’avoir à régulariser le dépôt dans un délai qui lui est imparti par le directeur général de l’Institut national de la propriété industrielle et qui ne saurait être inférieur à deux mois ou supérieur à quatre mois. A défaut de régularisation, le dépôt est rejeté.

Le dépôt, dès qu’il est reconnu conforme, est enregistré. L’enregistrement est notifié au déposant et mentionné au Bulletin officiel de la propriété industrielle.
