I.- Opposition to the opening of a medical biology laboratory or a new site or to the transfer of an existing site, pursuant to Article L. 6222-2, and opposition to the operations referred to in Article L. 6222-3 , shall be notified by reasoned decision of the General Director of the Regional Health Agency concerned, by any means capable of conferring a date certain on such notification, no later than two months after the date on which the file was declared or deemed to be complete pursuant to Article D. 6222-7.
Before implementing these powers of objection, the Director General of the Regional Health Agency will notify the legal representative of the laboratory by any means that can be used to establish the date on which the notification was made, so that the laboratory can submit its observations within a period of fifteen days.
II – The Director General of the Regional Health Agency, when notified of a declaration to open a laboratory site whose location does not comply with the provisions of the first paragraph of Article L. 6222-5, may not oppose it by granting the derogation provided for in that same article under the conditions laid down in the provisions of Article R. 6222-4. It shall notify this decision under the conditions laid down in I of this article.
