Article R623-16 of the French Intellectual Property Code

Subject to the provisions of article R. 623-44, any application for a plant variety certificate duly filed shall be published in an official bulletin to be issued by the national plant variety authority.

The purpose of this publication is, in particular, to bring the plant variety certificate application to the attention of any person having an interest therein.

The publication shall mention the filing date, the name and address of the applicant and that of the breeder where the latter is not the applicant, the proposed denomination or, failing this, the breeder’s reference, an indication of the genus or species to which the variety belongs and its summary characteristics.

From the day of the publication provided for in the preceding paragraphs, any person may take cognisance of the application as entered in the Register of applications for plant variety certificates.

Sous réserve des dispositions de l’article R. 623-44, toute demande de certificat d’obtention végétale régulièrement déposée fait l’objet d’une publication dans un bulletin officiel qui sera édité par l’instance nationale des obtentions végétales.

Cette publication a notamment pour objet de porter la demande de certificat d’obtention végétale à la connaissance de toute personne y ayant intérêt.

La publication mentionne la date de dépôt, le nom et l’adresse du déposant et celui de l’obtenteur lorsque ce dernier n’est pas le déposant, la dénomination proposée ou, à défaut, la référence d’obtenteur, l’indication du genre ou espèce auquel appartient la variété et ses caractéristiques sommaires.

A compter du jour de la publication prévue aux alinéas précédents, toute personne peut prendre connaissance de la demande telle qu’elle est inscrite au Registre des demandes de certificat d’obtention végétale.
