Article R623-31 of the French Intellectual Property Code

The annual fee provided for in the second paragraph of Article L. 623-16 is payable for the first time on the date of issue of the plant variety certificate. It must be paid within two months of the notification made by the national plant variety authority to the owner of the plant variety certificate.

For subsequent years, it expires on the last day of the month of the anniversary date of the grant of the plant variety certificate.

Where, from the second year onwards, payment of the annual fee has not been made by the due date as defined above, the said fee may still validly be paid within a further period of six months on payment of a late fee.

La redevance annuelle prévue au deuxième alinéa de l’article L. 623-16 est exigible pour la première fois à la date de la délivrance du certificat d’obtention végétale. Elle doit être versée dans les deux mois de la notification qui est faite par l’instance nationale des obtentions végétales au propriétaire du certificat d’obtention végétale.

Pour les années suivantes, elle vient à échéance le dernier jour du mois de la date anniversaire de la délivrance du certificat d’obtention végétale.

Lorsqu’à partir de la deuxième année le paiement de la redevance annuelle n’a pas été effectué à l’échéance telle qu’elle est définie ci-dessus, ladite redevance peut encore valablement être versée dans un délai supplémentaire de six mois moyennant le paiement d’une redevance de retard.
