Article R623-33 of the French Intellectual Property Code

Where payment of an annual fee, accompanied, where applicable, by the late payment fee, has not been made within the time limits prescribed above, the person in charge of the tasks falling within the remit of the national plant variety authority shall record the lapse of the breeder’s right.

This lapse is entered in the National Register of Plant Variety Certificates and published in the Official Bulletin of the national plant variety authority. It shall be substantiated and notified to the owner of the plant variety certificate on the date of entry in the National Register of Plant Variety Certificates. The interested party is advised that he has a period of six months from the expiry of the last deadline in which to submit an appeal to the person in charge of the tasks falling within the remit of the national plant variety authority with a view to having his rights restored, under the conditions laid down in Article L. 623-23.

To be valid, the appeal must be accompanied by proof of payment of the annual fee and a fee for registration of the appeal in the National Register of Plant Variety Certificates.

Lorsque le paiement d’une redevance annuelle, accompagné, le cas échéant, de la redevance de retard, n’a pas été effectué dans les délais prescrits ci-dessus, le responsable des missions relevant de l’instance nationale des obtentions végétales constate la déchéance du droit de l’obtenteur.

Cette déchéance est inscrite au Registre national des certificats d’obtention végétale et publiée au Bulletin officiel de l’instance nationale des obtentions végétales. Elle est motivée et notifiée au propriétaire du certificat d’obtention végétale à la date de l’inscription au Registre national des certificats d’obtention végétale. L’intéressé est avisé qu’il dispose d’un délai de six mois à compter de l’expiration du dernier délai pour présenter au responsable des missions relevant de l’instance nationale des obtentions végétales un recours en vue d’être restauré dans ses droits, dans les conditions prévues par l’article L. 623-23.

Pour être valable, le recours doit être accompagné de la justification du versement de la redevance annuelle et d’une redevance pour inscription du recours au Registre national des certificats d’obtention végétale.
