Article R623-37 of the French Intellectual Property Code

A breeder whose rights may be forfeited pursuant to 1° and 2° of the first paragraph of Article L. 623-23 shall be given formal notice to put an end to this situation by means of a notification sent to him/her by the person in charge of the tasks falling within the remit of the national plant variety authority. If, on expiry of a period of two months from receipt of the notification, this formal notice has remained without effect, the person in charge of the tasks falling within the remit of the national plant variety authority shall declare that the breeder’s rights have lapsed.

The decision of the person in charge of the tasks of the national plant variety authority is notified to the owner of the plant variety certificate. It is entered in the National Register of Plant Variety Certificates and published in the Official Bulletin of the national plant variety authority.

L’obtenteur susceptible d’être déchu de ses droits en application du 1° et du 2° du premier alinéa de l’article L. 623-23 est mis en demeure de faire cesser cette situation par une notification qui lui est adressée par le responsable des missions relevant de l’instance nationale des obtentions végétales. Si, à l’expiration d’un délai de deux mois à compter de la réception de la notification, cette mise en demeure est restée sans effet, le responsable des missions relevant de l’instance nationale des obtentions végétales constate la déchéance du droit de l’obtenteur.

La décision du responsable des missions relevant de l’instance nationale des obtentions végétales est notifiée au propriétaire du certificat d’obtention végétale. Elle est inscrite au Registre national des certificats d’obtention végétale et publiée au Bulletin officiel de l’instance nationale des obtentions végétales.
