Article R623-4 of the French Intellectual Property Code

The application for a plant variety certificate must include in particular:

– a description of the manner in which the variety was obtained or discovered;

– a full description of the variety with mention of the characteristics which, in the applicant’s opinion, enable it to be distinguished from varieties already known. For varieties whose commercial production requires the repeated use of another variety, the characteristics of that other variety must also be described;

– the denomination proposed by the breeder ;

– the indication, where applicable, of the States in which an application for protection has been filed and the authorisation for the person in charge of missions under the national plant variety authority to exchange with the competent authorities of any State or any intergovernmental organisation, whether or not a member of the International Union for the Protection of New Varieties of Plants, all items of information on the results of examinations which are in progress or which may have been carried out on the said variety.

Drawings or photographs and any information likely to enlighten the national plant variety authority may be annexed to the request, in particular concerning official or private growing tests carried out in France or abroad.

Article R623-4

La demande de certificat d’obtention végétale doit comporter notamment :

– une description de la manière selon laquelle la variété a été obtenue ou découverte ;

– une description complète de la variété avec mention des caractères permettant, selon le requérant, de la distinguer des variétés déjà connues. Pour les variétés dont la production commerciale nécessite l’emploi répété d’une autre variété, les caractères de cette autre variété doivent être également décrits ;

– la dénomination proposée par l’obtenteur ;

– l’indication, le cas échéant, des Etats dans lesquels une demande de protection a été déposée et l’autorisation pour le responsable des missions relevant de l’instance nationale des obtentions végétales d’échanger avec les autorités compétentes de tout Etat ou de toute organisation intergouvernementale membre ou non de l’Union internationale pour la protection des obtentions végétales tous les éléments d’information sur les résultats des examens qui sont en cours ou qui ont pu être effectués sur ladite variété.

Peuvent être annexés à la demande des dessins ou photographies et tous renseignements susceptibles d’éclairer l’instance nationale des obtentions végétales et concernant notamment des examens en culture, officiels ou privés, entrepris en France ou à l’étranger.
