Article R623-40-1 of the French Intellectual Property Code

The mention of essentially derived varieties within the meaning of IV of article L. 623-4, whether or not covered by a plant variety certificate, identified by their variety denomination, may be registered in addition to the compulsory information relating to the plant variety certificate for a protected initial variety.

It may also be entered in addition to the compulsory particulars relating to the certificate of an essentially derived variety.

This additional information is entered :

upon notification to the person in charge of missions under the national plant variety authority of a judicial decision that has become res judicata;

upon production of one of the originals of the private deed recognising by the parties concerned the qualifications of initial variety and essentially derived variety; or

upon production of a declaration by the holder of the certificate relating to an initial variety if he is also a breeder of essentially derived varieties within the meaning of IV of Article L. 623-4.

The registration of additional terms does not engage the responsibility of the national plant variety authority.

Additional terms relating to essentially derived varieties may be published in the Official Bulletin of the national plant variety authority.

La mention de variétés essentiellement dérivées au sens du IV de l’article L. 623-4, faisant ou non l’objet d’un certificat d’obtention végétale, identifiées par leur dénomination variétale, peut être inscrite en complément des mentions obligatoires relatives au certificat d’obtention végétale d’une variété initiale protégée.

Elle peut également être inscrite en complément des mentions obligatoires relatives au certificat d’une variété essentiellement dérivée.

Cette mention complémentaire est inscrite :

-sur notification au responsable des missions relevant de l’instance nationale des obtentions végétales d’une décision judiciaire passée en force de chose jugée ;

-sur production de l’un des originaux de l’acte sous seing privé portant reconnaissance par les parties concernées des qualifications de variété initiale et variété essentiellement dérivée ; ou

-sur production d’une déclaration du titulaire du certificat portant sur une variété initiale s’il est également obtenteur de variétés essentiellement dérivées au sens du IV de l’article L. 623-4.
