Article R631-3 of the French Commercial code

When the court exercises its ex officio power and unless the interested parties have previously been invited to present their observations, the court shall cause the debtor to be summoned at the instance of the court clerk, by registered letter with acknowledgement of receipt, to appear within the time limit it shall set.

Attached to the summons shall be a note setting out the facts likely to justify the court exercising its ex officio power.

The court clerk shall send a copy of this note to the public prosecutor.

Lorsque le tribunal exerce son pouvoir d’office et à moins que les parties intéressées n’aient été invitées préalablement à présenter leurs observations, le tribunal fait convoquer le débiteur à la diligence du greffier, par lettre recommandée avec demande d’avis de réception, à comparaître dans le délai qu’il fixe.

A la convocation est jointe une note dans laquelle sont exposés les faits de nature à motiver l’exercice par le tribunal de son pouvoir d’office.


Le greffier adresse copie de cette note au ministère public.
