Article R6323-32 of the French Public Health Code

The application for authorisation referred to in Article L. 6323-4-3 shall be sent to the Director General of the Regional Health Agency by any means that provides a date of receipt. It is accompanied by an application file, the composition of which is set by order of the Minister for Health. Applications for renewal are submitted under the same conditions.

If the Director General of the Regional Health Agency does not respond to an initial application for authorisation within six months, or to an application for renewal within two months, this will be deemed to constitute acceptance of the application.

La demande d’autorisation mentionnée à l’article L. 6323-4-3 est adressée au directeur général de l’agence régionale de santé par tout moyen donnant date certaine à sa réception. Elle est accompagnée d’un dossier de candidature dont la composition est fixée par arrêté du ministre chargé de la santé. Les demandes de renouvellement sont présentées dans les mêmes conditions.

Le silence gardé par le directeur général de l’agence régionale de santé sur une première demande d’autorisation pendant six mois, et sur une demande de renouvellement pendant deux mois, vaut acceptation de la demande.
