Article R642-22 of the French Commercial code

The official receiver who orders, pursuant to Article L. 642-18, the sale of immovable property by judicial or amicable auction determines:

1° The starting price for each of the assets to be sold and the essential conditions of the sale;

2° The advertising procedures, taking into account the value, nature and location of the assets;

3° The procedures for visiting the assets.

When the sale is pursued by a creditor, pursuant to Article L. 643-2, the upset price is determined in agreement with the pursuing creditor.

The official receiver may specify that, in the absence of bids reaching this reserve price, the sale may take place at a lower reserve price that he fixes.

Le juge-commissaire qui ordonne, en application de l’article L. 642-18, la vente des immeubles par voie d’adjudication judiciaire ou amiable détermine :

1° La mise à prix de chacun des biens à vendre et les conditions essentielles de la vente ;

2° Les modalités de la publicité compte tenu de la valeur, de la nature et de la situation des biens ;

3° Les modalités de visite des biens.

Lorsque la vente est poursuivie par un créancier, en application de l’article L. 643-2, la mise à prix est déterminée en accord avec le créancier poursuivant.

Le juge-commissaire peut préciser qu’à défaut d’enchères atteignant cette mise à prix la vente pourra se faire sur une mise à prix inférieure qu’il fixe.
