Article R663-36 of the French Commercial code

By way of derogation from the provisions of Article R. 663-34, the president of the court shall, on a proposal from the official receiver, set the amount of advance payments to be credited against the remuneration of the judicial administrator, the judicial representative and the liquidator.

These advance payments are fixed on proof of completion of the work for which they are entitled to remuneration and in the light of a detailed provisional account of their emoluments and a statement of foreseeable legal costs drawn up in accordance with Article R. 663-1-1 where this is requested.

The total amount of the advance payments, which include the fee provided for in articles R. 663-18 to R. 663-20, may not exceed two thirds of the remuneration due to the court-appointed administrator, the judicial representative and the liquidator nor two thirds of the sum mentioned in the first paragraph of Article R. 663-13 or Article R. 663-31. No more than one instalment may be authorised per half-year.

Par dérogation aux dispositions de l’article R. 663-34, le président du tribunal fixe, sur proposition du juge-commissaire, le montant d’acomptes à valoir sur la rémunération de l’administrateur judiciaire, du mandataire judiciaire et du liquidateur.

Ces acomptes sont fixés sur justification de l’accomplissement des diligences au titre desquelles leur droit à rémunération est acquis et au vu d’un compte provisoire détaillé de leurs émoluments et d’un état de frais de justice prévisibles établi conformément à l’article R. 663-1-1 lorsque celui-ci est demandé.

Le montant total des acomptes, qui comprennent le droit prévu aux articles R. 663-18 à R. 663-20, ne peut excéder les deux tiers de la rémunération à l’administrateur judiciaire, due au mandataire judiciaire et au liquidateur ni les deux tiers de la somme mentionnée au premier alinéa de l’article R. 663-13 ou de l’article R. 663-31. Il ne peut être autorisé plus d’un acompte par semestre.
