I.-The application to open a business as referred to in Article L. 681-1 shall be submitted in accordance with the provisions of Titles II to IV of this Book, subject to the following provisions:
1° The cash flow situation, the quantified statement of receivables and debts, the statement of assets and liabilities for securities and off-balance sheet commitments and the summary inventory of the debtor’s assets required by 2° and 5° to 7° of article R. 621-1 and 3° and 5° to 7° of article R. 631-1 are presented with a distinction between the debtor’s assets, rights or obligations relating to business assets and those relating to personal assets. The acts of waiver of protection of the personal assets of the sole trader provided for in Article L. 526-25 are mentioned, specifying the name of the creditor concerned and the amount of the commitment;

2° The documents and information mentioned in Articles R. 621-1 and R. 631-1 are supplemented by those mentioned in Articles R. 721-2 and R. 721-3 of the Consumer Code and, where applicable, by a copy of any waiver referred to in 1°.
II.-The debtor may request, in his application to open the procedure, the benefit of the measures for dealing with his over-indebtedness provided for in Book VII of the Consumer Code.
