The notice of the judgment referred to in article R. 611-43 and in the fifth paragraph of article R. 621-8 contains, in addition to the information provided for by these provisions, the name used for the exercise of the professional activity incorporating its name or customary name, immediately preceded or followed by the initials “EI” or “entrepreneur individuel” and an indication of the proceedings opened pursuant to II, III or IV of article L. 681-2.
Where IV of Article L. 681-2 or Article L. 681-3 is applied, the court registry notifies the judgment to the debtor and to the creditors whose existence has been indicated by the debtor. Where applicable, the court registry also notifies the judicial representative, the public prosecutor and the court-appointed administrator where one has been appointed. Notification to the other bodies and persons mentioned in articles R. 722-1 and R. 722-6 of the Consumer Code is carried out by the overindebtedness commission under the conditions laid down in these articles.
The decision to reject the application to open the procedure referred to in Article L. 681-1 is notified to the debtor by the court registry.
