Article R7124-19-3 of the French Labour Code

Approval, or renewal of approval, may only be granted when the child’s physical and psychological safety is sufficiently guaranteed.

As part of the examination of the application, the administrative authority defined in article R. 7124-1 may request that a copy of bulletin no. 2 of the criminal record be issued. No authorisation may be granted or renewed if it appears that the employer or one of its directors, partners or managers has been convicted of a crime listed in this bulletin.

L’agrément, ou le renouvellement d’agrément, ne peut être accordé que lorsque les garanties assurées à l’enfant quant à sa sécurité physique et psychique sont suffisantes.

Dans le cadre de l’instruction de la demande, l’autorité administrative définie à l’article R. 7124-1 peut demander la délivrance du bulletin n° 2 du casier judiciaire. Aucun agrément ne peut être accordé ou renouvelé s’il apparaît que l’employeur ou l’un de ses dirigeants, associés ou gérants ont fait l’objet d’une condamnation figurant sur ce bulletin.
