Article R7125-19 of the French General Code of Local Authorities

Training leave is granted as of right in order to take part in a training course or attend a training session that meets the criteria set out in article R. 7125-15.

It may, however, be refused by the employer if he considers, after consulting the works council or, failing that, the staff delegates where the company has them, that the employee’s absence would have detrimental consequences for production and the smooth running of the company.

If the employee renews his request at the end of a period of four months after notification of an initial refusal, a new refusal may not be made.

Le bénéfice du congé de formation est de droit pour effectuer un stage ou suivre une session de formation répondant aux critères fixés à l’article R. 7125-15.

Il peut cependant être refusé par l’employeur si celui-ci estime, après avis du comité d’entreprise ou, à défaut, des délégués du personnel lorsque l’entreprise en comporte, que l’absence du salarié aurait des conséquences préjudiciables à la production et à la bonne marche de l’entreprise.

Si le salarié renouvelle sa demande à l’expiration d’un délai de quatre mois après la notification d’un premier refus, un nouveau refus ne peut lui être opposé.
