Article R7125-25-2 of the French General Code of Local Authorities

Within the limit of the maximum amount set in application of 3° of article R. 1621-7 of the present code, the member of the assembly of French Guyana acquires his individual training rights counted in euros each year, as of the third Monday following the first round of the territorial election, and may ask to use them as of this acquisition. Regardless of the number of mandates held by the local elected representative, the volume of rights acquired each year under articles L. 2123-12-1, L. 3123-10-1, L. 4135-10-1, L. 7125-12-1, L. 7227-12-1 of this code and article L. 121-37-1 of the New Caledonian Local Authorities Code may not exceed the amount set by the decree mentioned in 2° of article R. 1621-7 of this code.

When they do not meet the conditions set out in the second paragraph of article R. 7125-25-3, elected representatives lose the individual training rights acquired in respect of their mandate when it expires. When an elected official holds several mandates giving rise to individual training rights, his rights are calculated taking into account the mandate for which he was elected or re-elected and which he has held for the longest period.

Dans la limite du montant maximal fixé en application du 3° de l’article R. 1621-7 du présent code, le membre de l’assemblée de Guyane acquiert ses droits individuels à la formation comptabilisés en euros chaque année, à compter du troisième lundi suivant le premier tour de l’élection territoriale, et peut demander à les utiliser dès cette acquisition. Quel que soit le nombre de mandats exercés par l’élu local, le volume des droits qu’il acquiert chaque année au titre des articles L. 2123-12-1, L. 3123-10-1, L. 4135-10-1, L. 7125-12-1, L. 7227-12-1 du présent code et de l’ article L. 121-37-1 du code des communes de la Nouvelle-Calédonie ne peut dépasser le montant fixé par l’arrêté mentionné au 2° de l’article R. 1621-7 du présent code.

Lorsqu’il ne remplit pas les conditions fixées au deuxième alinéa de l’article R. 7125-25-3, l’élu perd les droits individuels à la formation acquis au titre de son mandat à l’expiration de celui-ci. Lorsque l’élu exerce plusieurs mandats ouvrant des droits individuels à la formation, ses droits sont calculés en prenant en compte le mandat auquel il a été élu ou réélu qu’il exerce depuis le plus longtemps.
