Article R714-1 of the French Intellectual Property Code

The proprietor of a registered trade mark may renounce it at any time, in respect of all or some of the goods or services.

The declaration of renunciation must, in order to be admissible:

1° Be made by the proprietor of the trade mark entered, on the day of the declaration, in the National Trade Mark Register, or by his agent;

2° Be accompanied by proof of payment of the prescribed fee.

The provisions of Article R. 712-21 shall apply to the renunciation.

In the event of non-compliance of the declaration, reasoned notification shall be given to the applicant. The applicant is given a period in which to rectify the declaration or contest the Institute’s objections. If the declaration is not put in order or if no observations are made to remove the objection, the declaration is rejected. The notification may be accompanied by a proposal for rectification. This proposal is deemed to have been accepted if the applicant does not contest it within the time limit set.

Le titulaire d’une marque enregistrée peut à tout moment y renoncer, pour tout ou partie des produits ou services.

La déclaration de renonciation doit, pour être recevable :

1° Emaner du titulaire de la marque inscrit, au jour de la déclaration, sur le Registre national des marques, ou de son mandataire ;

2° Etre accompagnée de la justification du paiement de la redevance prescrite.

Les dispositions de l’article R. 712-21 sont applicables à la renonciation.

En cas de non-conformité de la déclaration, notification motivée en est faite au demandeur. Un délai lui est imparti pour régulariser la déclaration ou contester les objections de l’institut. A défaut de régularisation ou d’observation permettant de lever l’objection, la déclaration est rejetée. La notification peut être assortie d’une proposition de régularisation. Cette proposition est réputée acceptée si le demandeur ne la conteste pas dans le délai qui lui est imparti.
