Article R7153-6 of the French General Code of Local Authorities

An agreement between the State, represented jointly by the Minister of Foreign Affairs and the Minister responsible for Overseas Territories, and the territorial collectivity of French Guiana determines the conditions under which agents from this collectivity are received within France’s diplomatic missions. This agreement defines:

1° The duties of the employees of the territorial collectivity of French Guiana within the diplomatic mission in which they carry out their duties. These missions relate to regional cooperation actions. They may also include the possibility for these agents, at the request of the head of mission and with the agreement of the President of the Assembly of French Guyana, to provide their assistance to the smooth running of the diplomatic mission.

The precise duties of each agent shall be set out in a mission letter signed jointly by the president of the assembly of French Guiana and the head of mission;

2° Their geographical competence;

3° The training actions that may be organised to facilitate the exercise of the missions defined in 1° of this article ;

4° The material and logistical resources made available to each of the agents of the territorial authority of French Guyana within the diplomatic mission;

5° The relations between, on the one hand, each of the agents of the territorial authority and the head of mission and, on the other hand, the head of mission and the territorial authority of French Guyana. Each territorial agent shall regularly report on their actions to the head of mission and must comply with their directives pursuant to articles 3 and 6 of decree no. 79-433 of 1 June 1979 relating to the powers of ambassadors and the organisation of State services abroad. Each year, the head of mission shall send the president of the assembly of French Guyana his assessment of the manner in which each of the agents of this collectivity has served.

The agreement specifies the financial charges relating to the performance of the duties of the agents of the territorial authority of French Guyana within the diplomatic mission as well as their distribution between the State and this authority.

Une convention entre l’Etat, représenté conjointement par le ministre des affaires étrangères et le ministre chargé de l’outre-mer, et la collectivité territoriale de Guyane détermine les conditions d’accueil des agents de cette collectivité au sein des missions diplomatiques de la France. Cette convention définit :

1° Les missions des agents de la collectivité territoriale de Guyane au sein de la mission diplomatique dans laquelle ils exercent leurs fonctions. Ces missions ont trait aux actions de coopération régionale. Elles peuvent également comporter la possibilité pour ces agents, sur demande du chef de mission et avec l’accord du président de l’assemblée de Guyane, d’apporter leur concours au bon fonctionnement de la mission diplomatique.

Les fonctions précises de chaque agent sont fixées par une lettre de mission signée conjointement par le président de l’assemblée de Guyane et le chef de mission ;

2° Leur compétence géographique ;

3° Les actions de formation susceptibles d’être organisées pour faciliter l’exercice des missions définies au 1° du présent article ;

4° Les moyens matériels et logistiques mis à disposition de chacun des agents de la collectivité territoriale de Guyane au sein de la mission diplomatique ;

5° Les relations entre, d’une part, chacun des agents de la collectivité territoriale et le chef de mission et, d’autre part, le chef de mission et la collectivité territoriale de Guyane. Chaque agent territorial rend compte régulièrement de son action au chef de mission et doit se conformer à ses directives en application des articles 3 et 6 du décret n° 79-433 du 1er juin 1979 relatif aux pouvoirs des ambassadeurs et à l’organisation des services de l’Etat à l’étranger. Le chef de mission adresse chaque année au président de l’assemblée de Guyane son appréciation sur la manière de servir de chacun des agents de cette collectivité.

La convention précise les charges financières liées à l’exercice des fonctions des agents de la collectivité territoriale de Guyane au sein de la mission diplomatique ainsi que leur répartition entre l’Etat et cette collectivité.
