Article R716-1 of the French Intellectual Property Code

The application for invalidity or lapse referred to in Article L. 716-1 shall be made in writing in accordance with the terms and conditions laid down by decision of the Director General of the National Institute of Industrial Property.

It shall include:

1° The identity of the applicant;

2° Where applicable, information to establish the existence, nature, origin and scope of the prior rights invoked;

3° The references of the contested trade mark, together with an indication of the goods or services covered by the application for a declaration of invalidity or revocation;

4° A statement of the grounds on which the application for a declaration of invalidity or revocation is based, with the exception of an application based on Article L. 714-5;

5° Proof of payment of the prescribed fee;

6° Where applicable, except where he is an industrial property attorney or a lawyer, the representative’s power of attorney, which may be sent to the Institute within one month.

After it has been filed, the application for invalidity or revocation may not be extended to grounds or goods or services other than those invoked or referred to in the initial application.

La demande en nullité ou en déchéance mentionnée à l’article L. 716-1 est présentée par écrit selon les conditions et modalités fixées par décision du directeur général de l’Institut national de la propriété industrielle.

Elle comprend :

1° L’identité du demandeur ;

2° Le cas échéant, les indications propres à établir l’existence, la nature, l’origine et la portée des droits antérieurs invoqués ;

3° Les références de la marque contestée, ainsi que l’indication des produits ou services visés par la demande en nullité ou en déchéance ;

4° L’exposé des moyens sur lesquels repose la demande en nullité ou en déchéance, à l’exception de la demande fondée sur l’article L. 714-5 ;

5° La justification du paiement de la redevance prescrite ;

6° Le cas échéant, sauf lorsqu’il a la qualité de conseil en propriété industrielle ou d’avocat, le pouvoir du mandataire, ce pouvoir pouvant être adressé à l’Institut dans le délai d’un mois.

Après qu’elle a été formée, la demande en nullité ou en déchéance ne peut être étendue à d’autres motifs ou d’autres produits ou services que ceux invoqués ou visés dans la demande initiale.
