Article R722-7 of the French Commercial code

During the week following that of the election of the newly elected judges, the public prosecutor invites the judges of the commercial court established at the seat of the court of appeal who have not yet exercised judicial functions in a commercial court to attend the hearing of the court of appeal to take the oath.

Where the seat of the commercial court is not established at the seat of the court of appeal, the public prosecutor at the judicial court within whose jurisdiction the commercial court has its seat invites judges who have not yet exercised judicial functions in a commercial court to attend the hearing of the judicial court to take the oath.

A record shall be drawn up of the taking of the oath.

The term of office of consular judges begins on 1 January of the calendar year following their election and ends on 31 December of the calendar year following the election of their successor.

Au cours de la semaine suivant celle de l’élection des juges nouvellement élus, le procureur général invite les juges du tribunal de commerce établi au siège de la cour d’appel qui n’ont pas encore exercé de fonctions judiciaires dans un tribunal de commerce à se présenter à l’audience de la cour d’appel pour prêter serment.

Lorsque le siège du tribunal de commerce n’est pas établi au siège de la cour d’appel, le procureur de la République près le tribunal judiciaire dans le ressort duquel siège le tribunal de commerce invite les juges qui n’ont pas encore exercé de fonctions judiciaires dans un tribunal de commerce à se présenter à l’audience du tribunal judiciaire pour prêter serment.

Il est dressé procès-verbal de la réception du serment.

Le mandat des juges consulaires commence le 1er janvier de l’année civile suivant leur élection et s’achève le 31 décembre de l’année civile suivant l’élection de leur successeur.
