The data relating to voters registered on the electoral roll as well as that relating to the expression of the vote shall be the subject, in accordance with the procedures laid down by joint order of the Minister of Justice and the Minister of the Interior, issued after obtaining the opinion of the Commission nationale de l’informatique et des libertés, of automated processing of information carried out on separate computer systems known as the “voter file” and the “contents of the electronic ballot box”.
The “voters’ file” processing operation is based on the electoral lists drawn up by the commission referred to in article L. 723-3. The voters’ file enables the prefect to send each voter the authentication instruments mentioned in article R. 723-16, to identify the voters who have taken part in the electronic vote and to print out the list of votes cast. The tally indicates the time of the vote. Tally lists must be recorded on a medium separate from that of the electronic ballot box, sealed, non-rewritable, making its content unalterable and probative.
The file known as the “contents of the electronic ballot box” records the votes cast electronically. The data in this file is encrypted and must not contain any link enabling voters to be identified.
