Article R7413-3 of the French Labour Code

Subject to the application of Article L. 8232-2, relating to the obligations and solidarity of the principal, the responsibility of the homeworker for the application, to the auxiliary he uses, of all the provisions applicable to employees is, depending on whether the auxiliary is employed in his own home or in that of the homeworker:
1° Either that of a principal with regard to a homeworker;
2° Or that of a manager of an industrial undertaking with regard to a workshop worker.

Article R7413-3

Sous réserve de l’application de l’article L. 8232-2, relatif aux obligations et à la solidarité du donneur d’ordres, la responsabilité du travailleur à domicile pour l’application, à l’auxiliaire auquel il recourt, de l’ensemble des dispositions applicables aux salariés est, suivant que l’auxiliaire est employé à son propre domicile ou à celui du travailleur à domicile :
1° Soit celle d’un donneur d’ouvrage vis-à-vis d’un travailleur à domicile ;
2° Soit celle d’un chef d’entreprise industrielle vis-à-vis d’un ouvrier en atelier.
