Article R742-1 of the French Monetary and Financial Code

I.-The provisions of the articles mentioned in the left-hand column of the following table shall apply in New Caledonia, in the wording indicated in the right-hand column of the same table:

II.For the application of I:

1° In the second paragraph of Article R. 211-2, the words: “within the meaning of Regulation (EU) 2022/858 of the European Parliament and of the Council of 30 May 2022 on a pilot scheme for market infrastructures based on distributed ledger technology and amending Regulations (EU) No 600/2014 and (EU) No 909/2014 and Directive 2014/65/EU” are deleted;

2° In the second paragraph of Article R. 211-3, the words “within the meaning of Regulation (EU) 2022/858 of the European Parliament and of the Council of 30 May 2022 on a pilot scheme for market infrastructures based on distributed ledger technology and amending Regulations (EU) No 600/2014 and (EU) No 909/2014 and Directive 2014/65/EU” and “are set out in Article 7(6) of that Regulation” are deleted;

3° In the second paragraph of Article R. 211-4, the words “pursuant to Regulation (EU) 2022/858 of the European Parliament and of the Council of 30 May 2022 on a pilot scheme for market infrastructures based on distributed ledger technology and amending Regulations (EU) No 600/2014 and (EU) No 909/2014 and Directive 2014/65/EU” and “within the meaning of that Regulation” are deleted;

4° In the third paragraph of Article R. 211-6, the words “within the meaning of Regulation (EU) 2022/858 of the European Parliament and of the Council of 30 May 2022 on a pilot scheme for market infrastructures based on distributed ledger technology and amending Regulations (EU) No 600/2014 and (EU) No 909/2014 and Directive 2014/65/EU” and “on the basis of Article 5(2) of the aforementioned Regulation (EU) 2022/858” are deleted.

II.-Pour l’application du I :

1° Au second alinéa de l’article R. 211-2, les mots : “ au sens du règlement (UE) 2022/858 du Parlement européen et du Conseil du 30 mai 2022 sur un régime pilote pour les infrastructures de marché reposant sur la technologie des registres distribués, et modifiant les règlements (UE) n° 600/2014 et (UE) n° 909/2014 et la directive 2014/65/ UE ” sont supprimés ;

2° Au second alinéa de l’article R. 211-3, les mots : “ au sens du règlement (UE) 2022/858 du Parlement européen et du Conseil du 30 mai 2022 sur un régime pilote pour les infrastructures de marché reposant sur la technologie des registres distribués, et modifiant les règlements (UE) n° 600/2014 et (UE) n° 909/2014 et la directive 2014/65/ UE ” et “, sont fixées à l’article 7 paragraphe 6 dudit règlement ” sont supprimés ;

3° Au second alinéa de l’article R. 211-4, les mots : “ en application du règlement (UE) 2022/858 du Parlement européen et du Conseil du 30 mai 2022 sur un régime pilote pour les infrastructures de marché reposant sur la technologie des registres distribués, et modifiant les règlements (UE) n° 600/2014 et (UE) n° 909/2014 et la directive 2014/65/ UE ” et “ au sens de ce même règlement ” sont supprimés ;

4° Au troisième alinéa de l’article R. 211-6, les mots : “ au sens du règlement (UE) 2022/858 du Parlement européen et du Conseil du 30 mai 2022 sur un régime pilote pour les infrastructures de marché reposant sur la technologie des registres distribués, et modifiant les règlements (UE) n° 600/2014 et (UE) n° 909/2014 et la directive 2014/65/ UE ” et “ sur le fondement de l’article 5, paragraphe 2 du règlement (UE) 2022/858 précité ” sont supprimés.
