Article R742-22 of the French Commercial code

When selecting a successful candidate for the competition provided for in article R. 742-6-1, the Minister for Justice, the Keeper of the Seals, shall appoint, from among the candidates from the same promotion, where applicable, the highest-ranked candidate.

When selecting a company made up in whole or in part of successful candidates from the competition provided for in article R. 742-6-1, the Keeper of the Seals, Minister of Justice, shall ensure that, among the other candidates who meet the conditions for appointment and who have undertaken to pay the compensation, there is no successful candidate from the same graduating class who is ranked higher than any of the partners of the said company.

When several companies apply, each of which has a partner ranked higher than one of the partners of the other company, and no other candidate fulfilling the conditions of the previous paragraph is ranked higher, the Minister of Justice shall appoint one or other of these companies.

Lorsqu’il sélectionne un lauréat du concours prévu à l’article R. 742-6-1, le garde des sceaux, ministre de la justice, désigne, parmi les candidats issus d’une même promotion, le cas échéant, le candidat le mieux classé.

Lorsqu’il sélectionne une société composée pour tout ou partie de lauréats du concours prévu à l’article R. 742-6-1, le garde des sceaux, ministre de la justice, s’assure qu’il n’y a pas, parmi les autres candidats remplissant les conditions de nomination et s’étant engagé à payer l’indemnité, de lauréat issu de la même promotion et mieux classé que l’un quelconque des associés de ladite société.

Lorsque se portent candidates plusieurs sociétés dont chacune comporte un associé mieux classé que l’un des associés de l’autre société et qu’aucun autre candidat remplissant les conditions de l’alinéa précédent n’est mieux placé, le garde des sceaux, ministre de la justice, désigne l’une ou l’autre de ces sociétés.
