Article R742-23 of the French Commercial code

In the absence of candidates, the Minister of Justice may, in accordance with the conditions set out in Article R. 742-19, open a new deadline for the submission of applications. These are presented and examined in accordance with the provisions of article R. 742-21.

These provisions also apply if the Keeper of the Seals, Minister of Justice, does not select any of the candidates.

Where the appointed candidate is declared to have resigned pursuant to article R. 742-31, the Keeper of the Seals, Minister of Justice, may appoint another candidate, after re-examining the applications, under the conditions set out in Article R. 742-21. In the absence of acceptance from the interested party or if no candidate is appointed, the Keeper of the Seals, Minister of Justice, may open a new procedure under the conditions defined in articles R. 742-19 and R. 742-21.

En l’absence de candidature le garde des sceaux, ministre de la justice, peut, dans les conditions prévues à l’article R. 742-19, ouvrir un nouveau délai pour le dépôt des candidatures. Celles-ci sont présentées et instruites, conformément aux dispositions de l’article R. 742-21.

Ces dispositions sont également applicables si le garde des sceaux, ministre de la justice, ne retient aucun des candidats.

Lorsque le candidat nommé est déclaré démissionnaire en application de l’article R. 742-31, le garde des sceaux, ministre de la justice, peut nommer un autre candidat, après nouvel examen des candidatures, dans les conditions prévues à l’article R. 742-21. A défaut d’acceptation de l’intéressé ou si aucun candidat n’est nommé, le garde des sceaux, ministre de la justice, peut ouvrir une nouvelle procédure dans les conditions définies aux articles R. 742-19 et R. 742-21.
