Article R743-10 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The order of the liberty and detention judge may be appealed to the first president of the court of appeal, within twenty-four hours of its pronouncement, by the foreign national, the departmental prefect and, in Paris, the police prefect. If the foreign national does not attend the hearing, the time limit runs from the date of notification. The time limit thus provided for is calculated and extended in accordance with articles 640 and 642 of the Code of Civil Procedure.
The Public Prosecutor may appeal against this order in accordance with the same procedures when he does not request provisional suspension.

L’ordonnance du juge des libertés et de la détention est susceptible d’appel devant le premier président de la cour d’appel, dans les vingt-quatre heures de son prononcé, par l’étranger, le préfet de département et, à Paris, le préfet de police. Lorsque l’étranger n’assiste pas à l’audience, le délai court pour ce dernier à compter de la notification qui lui est faite. Le délai ainsi prévu est calculé et prorogé conformément aux articles 640 et 642 du code de procédure civile.
Le ministère public peut interjeter appel de cette ordonnance selon les mêmes modalités lorsqu’il ne sollicite pas la suspension provisoire.
