Article R743-139-9 of the French Commercial code

The Minister for Justice shall obtain the reasoned opinion of the board of the National Council of Commercial Court Clerks, in particular on the applicant’s good character, professional abilities and the compliance of the employment contract with the code of ethics and professional rules.

If, twenty days after the matter has been referred to it, by any means capable of conferring a date certain, the National Council has not sent the Minister of Justice the opinion requested of it, it is deemed to have issued a favourable opinion.

Le garde des sceaux, ministre de la justice, recueille l’avis motivé du bureau du Conseil national des greffiers des tribunaux de commerce, notamment sur l’honorabilité, les capacités professionnelles du candidat et sur la conformité du contrat de travail avec le code de déontologie et les règles professionnelles.

Si, vingt jours après sa saisine, par tout moyen permettant de conférer date certaine, le Conseil national n’a pas adressé au garde des sceaux, ministre de la justice, l’avis qui lui a été demandé, il est réputé avoir émis un avis favorable.
