Article R743-142 of the French Commercial code

I.-For the category of judicial documents mentioned in Table 2 of Appendix 4-7, the emolument relating to each service:

1° Includes the cost of a certified copy, bearing the executory formula and a copy issued to each party;

2° Is subject to a reduction in the event of striking out before a judgment or order has been handed down, except in cases where an emolument has been specially levied for bringing the matter before the court.

II.-For all the services mentioned in Table 2 of Article Appendix 4-7, the fee determined by the joint order made pursuant to Article L. 444-3 shall apply to the fees charged by the registry secretariats of the judicial courts dealing with commercial matters or by those of the mixed commercial courts.

I.-Pour la catégorie des actes judiciaires mentionnée au tableau 2 de l’article annexe 4-7, l’émolument afférent à chaque prestation :

1° Comprend le coût d’une copie certifiée conforme, revêtue de la formule exécutoire et d’une copie délivrée à chaque partie ;

2° Fait l’objet d’une minoration en cas de radiation avant le prononcé d’un jugement ou d’une ordonnance, sauf dans le cas où un émolument a été spécialement perçu pour la saisine du tribunal.

II.-Pour toutes les prestations mentionnées au tableau 2 de l’article annexe 4-7, l’émolument déterminé par l’arrêté conjoint pris en application de l’article L. 444-3 s’applique aux redevances perçues par les secrétariats-greffes des tribunaux judiciaires intervenant en matière commerciale ou par ceux des tribunaux mixtes de commerce.
