Article R743-15 of the French Monetary and Financial Code

I. – Subject to the adaptations provided for in II, the provisions of the articles mentioned in the left-hand column of the table below shall apply in French Polynesia, in the wording indicated in the right-hand column of the same table:

II. – For the application of I:

1° In article R. 221-2, the words: “and 76,500 euros for the associations mentioned in the first paragraph of article L. 221-3” are deleted;

2° In article R. 221-2-1, the words: “the summary sheet referred to in Article 1 of Decree no. 2016-1822 of 21 December 2016 laying down the content of the summary sheet for co-ownership provided for by Article 8-2 of the Act of 10 July 1965 laying down the status of co-ownership of built-up properties” are replaced by the words: “a summary sheet for co-ownership”;

3° In Articles R. 221-3, R. 221-5 and R. 221-8-1, the words: “the credit institution mentioned in article L. 518-25-1” are replaced by the words: “the Office des Postes et Télécommunications”;

4° In article R. 221-8, the words: “and the Livret de Développement Durable et Solidaire” are deleted;

5° In article R. 221-9:

a) The words: “or the Livret de Développement Durable et Solidaire” are deleted;

b) After the words “for investment by”, the end of 1° of I is worded as follows: “micro, small and medium-sized enterprises, which are defined as follows:

“the category of micro, small and medium-sized enterprises (SMEs) is made up of companies employing fewer than 250 people and whose annual turnover does not exceed 5,966,500,000 Pacific francs or whose annual balance sheet total does not exceed 5,131,190,000 Pacific francs;

– in the category of SMEs, a small company is defined as a company employing fewer than 50 people and whose annual turnover or annual balance sheet total does not exceed 1,193,300,000 Pacific francs;

“in the SME category, a micro-business is defined as a business employing fewer than 10 people and whose annual turnover or annual balance sheet total does not exceed 238,660,000 Pacific francs.

I. – Sont applicables en Polynésie française, sous réserve des adaptations prévues au II, les dispositions des articles mentionnés dans la colonne de gauche du tableau ci-après, dans leur rédaction indiquée dans la colonne de droite du même tableau :

II. – Pour l’application du I :

1° A l’article R. 221-2, les mots : ” et 76 500 euros pour les associations mentionnées au premier alinéa de l’article L. 221-3″ sont supprimés ;

2° A l’article R. 221-2-1, les mots : ” de la fiche synthétique mentionnée à l’article 1er du décret n° 2016-1822 du 21 décembre 2016 fixant le contenu de la fiche synthétique de la copropriété prévue par l’article 8-2 de la loi du 10 juillet 1965 fixant le statut de la copropriété des immeubles bâtis” sont remplacés par les mots : ” d’une fiche synthétique de copropriété” ;

3° Aux articles R. 221-3, R. 221-5 et R. 221-8-1, les mots : ” l’établissement de crédit mentionné à l’article L. 518-25-1″ sont remplacés par les mots : ” l’Office des postes et télécommunications” ;

4° A l’article R. 221-8, les mots : ” et du livret de développement durable et solidaire” sont supprimés ;

5° A l’article R. 221-9 :

a) Les mots : ” ou le livret de développement durable et solidaire” sont supprimés ;

b) Après les mots : ” d’investissement des”, la fin du 1° du I est ainsi rédigée : ” micro, petites et moyennes entreprises, qui sont définies de la manière suivante :

” – la catégorie des micro, petites et moyennes entreprises (PME) est constituée des entreprises qui occupent moins de 250 personnes et dont le chiffre d’affaires annuel n’excède pas 5 966 500 000 francs Pacifique ou dont le total du bilan annuel n’excède pas 5 131 190 000 francs Pacifique ;

” – dans la catégorie des PME, une petite entreprise est définie comme une entreprise qui occupe moins de 50 personnes et dont le chiffre d’affaires annuel ou le total du bilan annuel n’excède pas 1 193 300 000 francs Pacifique ;

” – dans la catégorie des PME, une microentreprise est définie comme une entreprise qui occupe moins de 10 personnes et dont le chiffre d’affaires annuel ou le total du bilan annuel n’excède pas 238 660 000 francs Pacifique.”
